Arizona does not run a CON program for health care facilities. A separate 'certificate of necessity' is still required to operate a ground ambulance service (A.R.S. §36-2233; ADHS decides within 180 days of application, excluding time the applicant takes to answer requests). Ambulance CON rules were last revised in 2022, effective January 1, 2024. HB 2197 (2025, 57th Legislature) proposed repealing the ambulance certificate of necessity; §36-2233 remains in the published statutes.
