The current Idaho Code contains no certificate of need requirement for health facilities. HB 91 (2025), a Department of Health and Welfare cleanup bill removing obsolete law, repealed the Idaho Health Planning Act (Idaho Code Title 39, Chapter 49), and the Legislature's code now lists that chapter as repealed.
